Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records of the respondent in AP. No.589/2003/A7 dated 21.10.2003, quash the same and direct the respondent to take the appeal on record and dispose the same in accordance with law.
For Petitioner : Mr.M.Hariharan O R D E R Learned counsel for the petitioner seeks the permission of this Court to withdraw this petition with liberty to file fresh appeal and he has also made an endorsement to that effect in the petition.
Recording the endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn with liberty granted to the petitioner to file a fresh appeal. No costs.
