Judgment: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the appellant, after arguing for some time, submits that he wants to withdraw the appeal with liberty to take appropriate action in terms of the leave granted by the learned trial Judge in the impugned order.
In view of the aforesaid submission of the learned counsel, we dismiss the writ appeal as being withdrawn with liberty to the appellant to take action, as has been observed by His Lordship in the impugned order.
Consequently, the miscellaneous applications, if any pending, shall also stand closed. No costs.
