JUDGMENT / ORDER

RATHANGAPANI REDDY COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to enlarge the petitioner/ A1 on bail in the event of her arrest by the respondent Station House Officer, Jammalamadugu (U), Police station, YSR Kadapa District in Cr.No.37/2014.
The Court made the following Order:
“This Criminal Petition is filed by the petitioner – accused No.1, under Section 438 Cr.P.C, seeking release in the event of her arrest in connection with Crime No.37 of 2014 of Jammalamadugu Urban Police Station, YSR Kadapa District registered for the offences punishable under Sections 494 and 497 IPC.
The averments in the report would disclose that the marriage of the informant was performed with A.1 on 02.12.2001. The informant and A.1 were working as teachers and were blessed with two daughters. It is alleged that A.1, having developed illegal intimacy with A.2, deserted the informant and her children and married A.2. Out of wedlock, she was blessed with a male child. Basing on the above allegations, the above crime came to be registered.
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.
A perusal of the material placed before this Court would indicate that A.1 got herself separated from the informant in the year 2006 and since then she was living separately. Subsequently, A.1 married A.2 and they were blessed with a child. Eight years after the desertion, the informant (husband of A.1) filed the present report. Having regard to the facts and circumstances of the case and taking into account the fact that
A.1 is working as a teacher in a government school, I am inclined to grant anticipatory bail to the petitioner.
2 Accordingly, the Criminal Petition is allowed. The petitioner is directed to surrender before the Station House Officer, Jammalamadugu Urban Police Station, YSR Kadapa District within a period of ten days from today and on such surrender, she shall be released on bail on her executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a likesum to the satisfaction of the same Station House Officer.”
