The petitioner, who is the wife of the respondent, has filed the above Transfer Petition to withdraw and transfer G.W.O.P.No.105 of 2016 on the file of Principal District Court, Thiruvallur, to the file of III Additional Family Court, Chennai, to be tried along with F.C.O.P.No.464 of 2016.
2. The respondent / husband filed an original petition in F.C.O.P. No.464 of 2016 for divorce. G.W.O.P.No.105 of 2016 was also filed by the respondent / husband for the custody of the minor child. The learned counsel appearing for the respondent, on instructions, submitted that the respondent has no objection for withdrawing and transferring G.W.O.P.No.105 of 2016 pending on the file of Principal District Court, Thiruvallur, to the file of III Additional Family Court, Chennai, to be tried along with F.C.O.P.No.464 of 2016.

In view of the submission made by the learned counsel on either side, the original petition in G.W.O.P.No.105 of 2016 pending on the file of Principal District Court, Thiruvallur, is withdrawn and transferred to the file of III Additional Family Court, Chennai, to be tried along with F.C.O.P.No.464 of 2016. The learned III Additional Judge, Family Court, Chennai, is directed to take both the matters together and dispose of the same on merits and in accordance with law.
4. With these observations, the Tr.C.M.P. is allowed. No costs. Consequently, C.M.P.No.1547 of 2017 is closed. The learned Principal District Judge, Thiruvallur, is directed to despatch the papers to the III Additional Family Court within two (2) weeks from the date of receipt of a copy of this order.
