JUDGMENT / ORDER

THE HONOURABLE MR. JUSTICE M.V.MURALIDARAN CONTEMPT PETITION No.510 of 2017 R.Hemalatha ... Contemnor Suo Motu Contempt Proceedings initiated against the Contemnor herein as per order of the Hon'ble Court dated 07.03.2017 and made in CRP.No.587 of 2012 For Contemnor :M/s.R.Perumalsamy ORDER Civil Revision Petition was taken up for hearing on 22.12.2016 and this Court has passed the following order:
"As per the order of this Court dated 13.02.2012, the petitioner was directed to comply with the condition imposed on him to deposit the entire arrears of rent, a sum of Rs.1,75,000/- on or before 27.02.2012. As the petitioner has not complied with the above direction, this Court by order dated 15.12.2016 was inclined to allow the condone delay application, subject to the above condition being complied with.

2. Today the learned counsel appearing for the petitioner filed an affidavit of service in proof of compliance of the condition and the counsel for the respondent is not disputed.
3. Hence, the restoration application is allowed, on numbering the restoration application by the Registry. Post the matter on 09.01.2017 "for orders".
2. Thereafter, the main Civil Revision petition was heard and reserved for judgment.

When the matter is taken up for hearing today i.e., 15.06.2017, the learned counsel for the petitioner represented that this Court has directed the petitioner to pay a sum of Rs.1,75,000/- to the respondent. But, the petitioner has not complied with the above direction of this Court issued vide order dated 15.12.2016 and hence the petitioner has filed a condone delay application for non compliance of the above said order. Thereafter, the said application was allowed subject to the above condition being complied with.
4. The learned counsel for the respondent represented that the petitioner made a false representation before this Court. Since the petitioner has not complied with the conditional order as directed by this Court on 13.02.2012, for depositing the sum of Rs.1,75,000/-, this Court initiated Suo Mottu Contempt against the petitioner for non compliance of the conditional order dated 13.02.2012.

After issuance of the contempt notice, the petitioner appeared before this Court and prayed this Court that she is ready and willing to pay the entire amountand the counsel for the respondent also agreed for the same. Hence, along with the contempt petition, the Civil Revision Petition is also posted today. When the matter has been posted today, a memo has been filed by the petitioner by stating that the petitioner has paid the cash amount of Rs.1,75,000/- towards the rental arrears on 13.06.2017 as was passed in the conditional order by this Court on 13.02.2012 and prayed for close the Contempt Petition.
6. The learned counsel for the respondent Mr.P.S.Vasanthakumar has also agreed that the receipt of the entire amount and prayed this Court for closure of the Contempt Petition.
7. Recording the above submission, this contempt petition is closed.
