JUDGMENT
[JUDGMENT OF THE COURT WAS DELIVERED BY C.T.SELVAM, J] This Civil Miscellaneous Appeal has been preferred against the judgement and decree dated 31.05.2010 made in F.C.O.P.No.1300 of 2004 on the file of the Principal Family Court at Chennai.
2. Heard learned counsel for appellant. Both appellant and respondent are present. Parties have lived apart for very many years. While both parties are not keen on revisiting the matrimonial bond, the appellants concern is that she should not lose marital status by subsequent act of respondent seeking divorce on ground available u/s. 13 1-A (i) of the Hindu Marriage Act, 1955. Such concern is redressed under endorsement made by the respondent/husband in his affidavit dated 30.10.2017 and in the presence of this Court today to the effect 'Kindly note that I will undertake not to file any divorce petition in future'.
3. In the aforesaid circumstances, this Civil Miscellaneous Appeal is disposed of. The affidavit filed by respondent/husband shall form part of the judgment. No costs.
