The writ petition has been filed for calling for the records of the 3rd respondent relating to the notification in Na.Ka.No.86/2010 Kanimam dated 12.4.2010 as published in Madurai District Gazette Extra-ordinary issue No.17 dated 13.4.2010, in so far as it relates to the stone quarry in S.F.No.1163 admeasuring 0.80.5 hectare of Katchaikatti Village, Vadipatti Taluk, Madurai District as listed in Serial No.5 in the schedule to the Gazette Notification.
2.According to the petitioner, his lease for quarrying rough stone was cancelled on 16.08.2007, as against which, he had filed an appeal before the Commissioner/Director of Geology and Mining, which was also dismissed on 19.11.2008. Aggrieved against the same, he had preferred a second appeal before the Deputy Secretary to Government. In the mean time, since the third respondent had notified the petitioner's land for grant of lease, the present writ petition came to be filed.
3.Pending writ petition, the second appeal preferred by the petitioner before the Deputy Secretary to Government came to be dismissed vide G.O.(D) No.165, Industries (MMC.2) Department, dated 13.09.2010 rejecting the petitioner's appeal and holding that the petitioner had violated the lease conditions.
4.In view of the rejection of the second appeal, no further adjudication is required in the present writ petition, challenging the third respondent's rejection order. Accordingly, this writ petition is dismissed as infructuous. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
