2. The petitioner has filed the above writ petition to issue a Writ of Mandamus, directing the 3rd respondent to dispose of his representation dated 26.07.2017, within a time frame.
3. Mr.B.Vijay, learned counsel appearing for the petitioner submitted that the petitioner has filed the appeal before the 1st respondent challenging the issuance of patta by the 3rd respondent and the same is pending till today.
4. Mr.Era.Premnath, learned Government Advocate appearing for the respondents 1 to 3 submitted that since the petitioner has not submitted a representation to the 1st respondent, the petitioner may be directed to give fresh representation to the 1st respondent and in such an event, the 1st respondent may be directed to consider the said representation, in accordance with law, after giving notice to all the interested parties.
5. In that view of the matter, the learned counsel appearing for the petitioner also sought permission of this court submit a fresh representation to the 1st respondent within a period of one week.
6. In view of the submissions made by the learned counsel on either side, I direct the petitioner to submit a fresh representation to the 1st respondent for issuance of patta, within one week from the date of receipt of a copy of this order and on receipt of the same, the 1st respondent is directed to consider the same and pass orders, on merits and in accordance with law, after giving notice to all the interested parties, within a period of eight weeks from the date of submission of the representation.
With these observations, the writ petition is disposed of. No costs.
