Heard Sri Kamal Krishna, learned Sr. Advocate assisted by Sri Dhyan Shanker Pandey, learned counsel for the applicant and and learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to direct the court below to hear and decide the proceedings of Case No. 3809 of 2021 (State Vs. Mohd. Shakir @ Banti and others), under Sections 379, 411, 120B, 109 IPC and 2/33/41/42/52/64 of Indian Forest Act & 4/10 Forest Conservation Act, arising out of Case Crime No. 337 of 2020, pending before the Judicial Magistrate Amroha, expeditiously within short span of time.
Learned counsel for the applicant states that a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of one year without permitting undue adjournments to either side, if there is no legal impediment.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court Order Date :- 20.12.2021 A.P. Pandey
