Heard learned counsel for the applicants and the learned A.G.A.
This application is filed by the applicants for quashing the entire proceeding including charge-sheet no. 149 of 2018 dated 01.07.2018, under Sections 363, 506 IPC and 11/12 POCSO Act in Case Crime No. 169 of 2018, P.S. Jansath, District Muzaffar Nagar and further challenging the proceedings of S.S.T. No. 181/9 of 2018 (State Vs. Sanwar And others) pending before Additional District and Sessions Judge Court No.8, Muzaffar Nagar and as well as order dated 12.11.2018 passed by Additional District and Session Judge Court No.8 Muzaffar Ngar.
After arguing at some length, learned counsel for applicants submits that grievance of applicants would be sufficiently met in case bail application of applicants is considered expeditiously in accordance with law.
In view thereof, it is provided that if the applicants surrenders before the Court below within three weeks from today and applies for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of three weeks, no coercive steps shall be taken against the applicants.
With the aforesaid, the application is disposed of.
