Heard Sri Kamlesh Kumar Singh, learned counsel for the petitioner, Sri Atma Prakash Tripathi, learned counsel for the respondent no.1- Union of India and learned Standing Counsel for the State respondents.
By means of this writ petition, the petitioner has come to this Court raising a grievance that his land being Arazi No. 38 area 0.025 hectare situated at village Shahpur Hata, Tehsil Chakia, District Chandauli has been acquired, but the compensation has not been paid so far.
It is to be noted that the Central Government for establishment of Group Centre/Range Mukhyalaya, CRPF, Chandauli, the land was acquired.
Upon instructions, learned counsel for the Union of India submits that the entire money for compensation have been deposited in the account of the District Magistrate, Chandauli and the District Magistrate has to pay the compensation as determined by the Authorities.
The writ petition is disposed of with the direction to the respondent no.3 - District Magistrate, Chandauli before whom the petitioner has already made an application and the District Magistrate shall consider the claim of the petitioner and pass appropriate orders as to whether the land of the petitioner has been acquired or not and whether the petitioner is entitled for any compensation or not, if it is found that he is entitled to compensation, appropriate compensation be paid to the petitioner, in accordance with law. The said decision be taken within a period of two months from the date of presentation of a certified copy of this order before the respondent no.3 by the petitioner.
With the aforesaid observation, the writ petition is finally
disposed of.
