JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE AKIL KURESHI)
1. Learned Government Pleader Mr. P.K. Jani stated under the instructions that the SLP filed by the State against the order of the Division Bench of this Court is likely to come up for hearing before Hon'ble the Apex Court in the week commencing from 7th May, 2012. Under the circumstances, this petition is adjourned to 12th June, 2012.
2. Learned counsel Shri Mehta for the applicants, however, submitted that some 27 workmen have not been engaged though previously assured before this Court. On 23.3.2012, with respect to this issue, we had recorded as under:
"6. On the other hand, learned Government Pleader Shri Jani stated on instructions that such workmen have stopped reporting since several years. In any case, if they or any of them report for duty, before Deputy Conservator of Forest, Vyara, they shall be engaged and given work as per the availability of work. Counsel for the applicants stated that the workmen will report for work within two weeks from today."

Learned counsel Shri Mehta drew our attention to letter dated 29th March, 2012 and 6th April, 2012 addressed to the Deputy Conservator of Forests, Vyara with respect to such workmen and submitted that despite these workmen having reported before the said authority, they are not re-engaged. Learned Government Pleader Shri P.K. Jani, under the instructions from Shri Mukesh Chauhan, Legal Superintendent to Principal Chief Conservator of Forests Government of Gujarat that whatever be the past misunderstanding, if such workmen report before the officer in charge of the Deputy Conservator of Forests, Vyara, the statement made on 23.3.2012 on behalf of the Government shall be complied with. Learned counsel Mr. Mehta for the applicant stated that all the workmen will report before the said officer on 5th May, 2012. When the workmen do so, it is directed that the concerned officer shall issue appropriate order to engage them as per the availability of work in their respective ranges. Learned Government Pleader Shri Jani stated that this statement and order shall be complied with without fail for which necessary instructions will be issued forthwith.
