High Court Of Kerala|19 November, 2014

JUDGMENT / ORDER

Heard the learned counsel for the petitioner, the learned Standing Counsel for the respondent corporation, as well as the learned Government Pleader, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. Briefly stated, the petitioner's son is said to be studying Plus 2 in a School 17 Kms away from home. To attend School, the petitioner's minor son has been travelling the distance by making use of the public transport provided by KSRTC, which has got more than 20 schedules operating in the route Koothattukulam – Ernakulam, via Piravom. The grievance of the petitioner is that despite repeated representations, the respondent authorities have not W.P.(c) No. 27745 of 2014 2 provided any travel concession to his son, a student, who is in fact entitled to the said concession. The petitioner has also submitted that in all other routes, respondent corporation has extended the bus fare concession.
3. A perusal of the record reveals that the petitioner has submitted Exhibit P4 representation before the District Transport Officer, though very recently. The learned counsel for the petitioner has urged this Court to issue a suitable direction to the said District Transport Officer to consider petitioner's Exhibit P4 representation and pass appropriate orders thereon.
4. In the facts and circumstances, having regard to the respective submissions of the learned counsel for the petitioner and the learned Standing Counsel for the respondent corporation, as well as the learned Government Pleader, without expressing any opinion on the merits of the matter, this Court disposes of the present writ petition with a direction to the District Transport Officer to consider Exhibit P4 representation of the petitioner in accordance with law, and pass appropriate orders thereon as expeditiously as possible, at any rate, within a period of four W.P.(c) No. 27745 of 2014 3 weeks from the date of receipt of a copy of this judgment.
With the above observation, this writ petition is disposed of.
