The petitioner has undertaken the work of Malabar package- construction of Staff Quarters type - II, 3 Blocks for Government College of Engineering Kannur. Petitioner raised a bill for the above work totalling of Rs.77,97,019/-. While so the petitioner was awarded with another work of GEC-Kannur-Construction of Ladies Hostel Building for SC/ST students. Petitioner need to furnish a security of Rs.34,84,900/- as Bank Guarantee or Treasury savings Deposit for the construction of ladies hostel. The petitioner has made a request before the 2nd respondent to adjust the amount due from the work relating to the construction of Government College of Engineering, Kannur towards security to be furnished for the present work relating to the construction of the Ladies Hostel building for SC/ST students. 2. A statement has been filed by the 3rd respondent in this matter. It is stated that out of the amount of Rs.77,97,019/-, an amount of Rs.55,97,112/- have already paid and the balance amount W.P.(C).No.27258 of 2014 2 payable is less than the amount to be furnished as security by the petitioner. Therefore, petitioner's request cannot be accepted.
3. Considering the fact that the amount required to be furnished by the petitioner towards security, the petitioner shall furnish the security less the amount payable to the petitioner for the work in Malabar package-construction of Staff Quarters type - II, 3 Blocks for Government College of Engineering Kannur.
The petitioner shall furnish such balance amount payable within the time prescribed by the 2nd respondent.
Writ petition is disposed of.
