(By Sri K.P. Yoganna, HCGP) …Petitioner …Respondent This Criminal Petition filed under Section 439 of Cr.P.C., praying to enlarge the petitioner on bail in Cr. No.54/2019 of Kushalnagar Police Station, Kodagu District, for the offences p/u/s 376 (2) (F) of IPC and Section 6 of POCSO Act.
This Criminal Petition coming on for Orders this day, the Court made the following:
O R D E R There is an allegation against petitioner, on the complaint lodged by the victim girl, aged 16 years, that on 4.7.2019, the petitioner has committed sexual act with her though knowing fully well that she was a minor girl.
2. FIR discloses the allegation under Section 376 of IPC and Sections 4 and 6 of POCSO Act. Investigation is still under progress. It is too premature, at this stage, to release the petitioner on bail. In the circumstances, the petition is liable to be dismissed with liberty to the petitioner to approach the competent Court after filing of the charge sheet.
Accordingly, the petition is dismissed.
