This petition for writ is preferred to have a direction for respondents to decide the application/complaint submitted by the petitioner as per Section 16 of the Prohibition of the Child Marriage Act, 2006.
Under the application/complaint aforesaid an allegation is made by the petitioner with regard to violation of Section 9, 10 and 11 of the Act of 2006.
It is submitted that no steps have yet been taken by the competent authorities by acting upon the application submitted by the petitioner.
On asking learned counsel for the petitioner states that marriage has already been solemnized in the year 2016. However, the girl subjected is yet minor.
On going through the facts stated in this petition for writ and the documents annexed thereto, it reveals that a criminal case was lodged against the secretary of the petitioner's association at the instance of the girl in relation to whose marriage, the application under Section 16 is preferred, for the offences under Protection of Children from Sexual Offences Act, 2012.
Looking to this fact, we are having doubts regarding bonafides of the petitioner, as such, we are not inclined to interfere in the matter while invoking the powers under Article 226 of the Constitution of India.
The writ petition is dismissed.
