The petitioner was assigned with land at Peringome Amsom in RS. No.295 as plot No.7 by the Government. Ext.P1 is Deed of Assignment. The petitioner approached the 2nd respondent with a request to demarcate the land assigned to him. Since the 2nd respondent has not taken steps to demarcate, the petitioner approached the District Collector. The District Collector appears to have directed the 2nd respondent Tahsildar to take necessary steps to demarcate the property and accept the basic tax. Due to inaction on the part of the respondents, the petitioner has approached this Court. 2. In view of the above facts and circumstances, there shall be a direction to the 2nd respondent-Tahsildar to demarcate the petitioner's property in the light of Ext.P1. While demarcating the property, if any person is found encroached upon the property which was assigned to the petitioner, W.P.(c).No. 26682 of 2014 : 2 :
necessarily the 2nd respondent shall take necessary action to remove illegal encroachments, if necessary with the assistance of the police authorities having jurisdiction. If any such request is made by the 2nd respondent in this regard, the police authorities concerned shall give all necessary assistance to the Tahsildar to remove illegal encroachment. The Tahsildar shall complete identification of the property assigned to the petitioner within a period of three months from the date of receipt of a copy of this judgment and thereafter accept the basic tax of the petitioner.
The writ petition is disposed of as above.
