Learned counsel for petitioner undertakes that he shall remove the defects pointed out by the Registry within a period of ten days of the withdrawal of lock-down restrictions.
Heard learned counsel for petitioner, Mr. Rakesh Kumar Chaudhary, learned counsel for respondent Nos. 2, 3 and learned Standing counsel for respondent Nos.1, 4, 5, 6.
The present writ petition is filed praying for recounting of the result of election for the post of Gram Pradhan.
At the very outset learned Standing Counsel and learned counsel for respondent Nos.2, 3 raises a preliminary objection that petitioner has statutory alternative remedy to file an election petition against the result of election for the post of Gram Pradhan under Section 12-C of U.P. Panchayat Raj Act, 1947.
Looking into the aforesaid, the present writ petition is disposed of with liberty to the petitioner to file an election petition as provided under law. In case such an election petition is filed, the concerned tribunal shall proceed and decide the same as expeditiously as possible.
