The present criminal revision has been filed against the order dated 30.5.2019 passed by Sessions Judge, Auraiya in Criminal Appeal No.19 of 2019 arising out of the judgment and order dated 17.5.2019 passed by Principal Magistrate/Juvenile Justice Board, Auraiya in Criminal Case No.6 of 2017 arising out of case crime no.62 of 2017 u/s 302, 394, 411 IPC PS Bidhuna District Auraiya.
The contention of the learned counsel for the revisionist is that the present prosecution has been instituted with mala fide intention for the purposes of harassment. He pointed out certain documents and statements in support of his contention. It is further contended that the order impugned has been passed without application of mind and is liable to be quashed.
After hearing the learned counsel for the parties and after perusing the order impugned as well averments made in the present revision, this Court is of the opinion, that learned counsel for the revisionist could not point out any illegality or perversity in the order impugned which may warrant any interference by this Court.
Accordingly, the revision lacks merit and is dismissed.
