Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed for quashing the entire proceeding including charge sheet dated 02.05.2018, Case Crime No. 45 of 2018, under Section 302, 323, 504, 452, 34 IPC, P.S. Panwari, District Mahoba pending before the concerned court below. It is further prayed that the proceedings of the said case may be stayed as the matter has been sent to C.B.C.I.D for further investigation and the investigation has been completed by the C.B.C.I.D.
I have perused the record which shows that the prayer as made in the application is totally misconceived and no such prayer can be allowed on such flimsy ground as has been taken in the affidavit.
After hearing learned counsel for the parties and after perusing the impugned FIR and also looking to the seriousness of the allegation as made in the FIR, gravity of offence and the severity of punishment and the fact as advanced by the learned AGA, no case for grant of any indulgence is made out.
Accordingly, the instant application is dismissed.
