Heard Sri Rajesh Kumar, learned counsel for the petitioner and Sri Balraj Srivastava, Advocate holding brief of Sri Satish Chaturvedi, learned counsel for respondent no. 4.
The petitioner has taken agricultural loan from the respondent no. 4 for agricultural purpose but due to some unavoidable circumstances, he could not deposit the installments on time and, therefore, the bank started recovery proceeding against him. In pursuance thereof, the respondent no. 2 has issued recovery certificate on 8.1.2019.
Learned counsel for the petitioner submits that the petitioner is ready and willing to pay the amount but some time may be granted, to which learned counsel for the respondent no. 4 has no objection.
Accordingly, the writ petition is disposed of with liberty to the petitioner to deposit the entire amount due in four equal installments; the first installment shall be paid by 31st July, 2019, the second by 31st October, 2019, the third by 31st December, 2019 and the fourth by 31st March, 2020. While depositing the last installment, the petitioner shall also pay the interest due on the date of payment of last installment. The respondents are restrained to take any coercive action against the petitioner during the aforesaid period. In case of any default by the petitioner in payment of the installment, the protection granted herein above shall stand automatically vacated.
