Petitioner is permitted to implead Chief Treasury Officer, Fatehpur as respondent no. 4 in the array of the parties. Notice on behalf of newly impleaded respondent is accepted by the learned Standing Counsel.
While entertaining the writ petition, following orders were passed on 27.7.2018:-
Petitioner was Auxiliary Nurse Midwife, who has superannuated on 31.05.2016. Her grievance is that even despite expiry of more than two years, the retiral benefits of the petitioner have not been released so far. Submission is that petitioner is being harassed.
Learned standing counsel may obtain instructions in the matter as why petitioner's retiral benefits have not been released so far?
Put up this matter, in the additional cause list, on 03.08.2018".
Learned Standing Counsel has obtained instructions, according to which pension, gratuity and leave encashment etc. has already been sanctioned to be paid to petitioner in the year 2016. So far as General Provident Fund and Insurance amount is concerned, it is stated that the claim has already been processed and forwarded to treasury for release of amount.
Nothing has been brought on record by the respondents to indicate as to why the amount of GPF and insurance was not paid to the petitioner without any delay. In view of the stand taken by the respondents that such claim has already been processed and forwarded for release of the amount to treasury, this petition stands disposed of with a direction upon the respondent nos.2 & 4 to ensure release of the entire amount due and payable towards the General Provident Fund and Group Insurance and other retiral dues payable, if any, within a period of two months from the date of presentation of certified copy of this order. The petitioner shall be entitled to payment of interest in terms of the relevant scheme/ Government Orders and the same shall be calculated and released within a further period of six weeks thereafter.
