Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue an order or writ one in the nature of writ of Mandamus, declaring Rule 10(5)(i), 10(5)(ii), S.I.No. 17 of Schedule II of Rule 10 and Schedule III of Rule 10 of A.P. Minor Mineral Concession Rules, 1966 framed by G.O.Ms.No. 104, Industries and Commerce Department, dt. 15-05-2009 as arbitrary, illegal and violation of Mines & Minerals (Development and Regulation) Act, 1957 and Rules.
The petition coming on for hearing, upon perusing the petition and the affidavit filed herein and the order of the High Court dated. 13-04-2010 made in WPMP.No. 10559/2010 and upon hearing the arguments of Smt. Shoba N, Advocate for the Petitioner, the Court made the following ORDER:
