Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State- respondents no.2 and 3.
The petitioner has preferred the present writ petition, inter alia, with the prayer to direct respondent no.4, namely, Umesh Pant to strictly abide by the orders passed by Civil Judge (Senior Division), Kanpur Nagar in Case No. 590 of 2019 (Smt. Pushpa Sharma Vs. Umesh Pant) In the said suit filed by the present writ petitioner ad-interim injunction was granted in her favour by the trial court on 16.5.2019. When the said order was not complied with, an application under Section 151 of the CPC was filed by the petitioner before the court below on 23.1.2020, a copy of which is appended as Annexure-6 to the writ petition.
It is argued that though considerable time has elapsed, but till date no decision has been taken. It is further argued that inspite of the order of the status quo illegal construction is being raised by respondent no.4 with the help of respondents no.2 and 3.
Heard learned counsel for the parties and perused the record.
In the facts and circumstances of the case, without expressing any opinion on the merits of the case, the court below is directed to pass appropriate orders on the aforesaid application preferably on the next date. If on account of any reason, no order is passed on the next date, the order should be passed preferably within a period of two weeks thereafter.
With the aforesaid observation/direction, the writ petition stands finally disposed of.
