By means of this writ petition the petitioner has prayed for compassionate appointment upon death of his brother, who was appointed as Lab Technician pursuant to some direction of the High Court. It is submitted that Special Appeal is also pending.
The writ petition is disposed of with the direction to respondent no. 2 that in case it is found the petitioner's brother was a permanent employee and the petitioner is dependent of his deceased brother and is eligible under the U.P. Recruitment of Dependents of Government Servants Dying in Harness Rules, 1974, the claim of the petitioner for compassionate appointment be considered and appropriate order be passed, as far as possible, within a period of four months from the date a certified copy of this order is presented before it.
