When the matter is called out and taken up for hearing, learned advocate Mr.Upadhyaya for respondent no.2 in writ petition being Special Civil Application No.14349 of 2011 has submitted that copy of Civil Application has not been served on respondent no.2. He also requested for time so far as main petition is concerned. Learned advocate Mr. Karia for the petitioner has also requested for some time so far as main petition is concerned.
Since grievance is made by respondent no.2 that copy of the Civil Application has not been served, let notice be issued to opponent nos.1 to 3 making it returnable on 26/07/2012. Learned AGP Mr.Yagnik waives service for respondent no.1. Learned advocate Mr. Pahwa waives service on behalf of respondent no.3. Direct service is permitted for respondent no.2.
