Written instruction filed by the learned Standing Counsel is taken on record.
Heard learned Counsel for the petitioner and Sri A.P. Paul, learned Standing Counsel for State as well as Sri Ritesh Kumar, Advocate holding brief of Sri Pradeep Singh, learned Counsel for the respondent no.6.
The writ petition has been filed to seek a direction to the respondents to process and decide the last representation dated 28.12.2020 made by the petitioner.
The representation was in reference to the certain works of Gram Panchayat containing allegation against the elected representative.
The instruction dated 11.08.2021 shows not only inquiry in reference to allegation made by the petitioner but a report therein finding charges not made out.
In the light of the aforesaid, now nothing remains because representation of the petitioner has already been given cognizance followed by the report, it is not only charge sheet was served but inquiry was also conducted followed by a report, thus the writ petition has become infructuous.
In view of above, the writ petition is dismissed as rendered infructuous.
However, a copy of the written instruction is supplied to the Counsel for the petitioner who would be at liberty to take legal recourse against the report, if he so chooses.
