1. Present petition under Section 482 of the Code of Criminal Procedure has been preferred by the petitioners herein - original accused to quash and set aside the impugned First Information Report being CR No.I-36 of 2011 registered with Bardoli Police Station, District Surat for the offences punishable under sections 498(A), 323, 504, 506(2) and 114 of Indian Penal Code.
2. After the matter was argued for sometime, Ms.Kruti Shah, learned advocate seeks permission to withdraw the present petition, however, requested to reserve the liberty in favour of the petitioners to submit appropriate application for discharge before the concerned Magistrate, in case, after the investigation, the petitioners are chargesheeted.
3. Permission as prayed for is granted. Present petition is dismissed as withdrawn with above liberty in favour of the petitioners herein. It goes without saying that after the investigation, if the petitioners are chargesheeted, and any application for discharged is submitted by the petitioners, the same shall be considered by the concerned Magistrate in accordance with law and on merits. With these, rule is discharged. Ad-Interim Relief granted earlier stands vacated forthwith.
