Heard Sri S.P. Pandey, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 9.3.2018 registered as case crime no. 118 of 2018 under sections 420, 467, 468, 471 I.P.C., police station Civil Lines, District Meerut.
Learned counsel for the petitioner submits that earlier the petitioner was implicated in a criminal case in the year 2008 F.I.R. of which was lodged against unknown person by respondent no. 5. Thereafter, he was acquitted in the said case by the competent court and when he got appointment in the police force, the respondent no. 5 lodged the present F.I.R. alleging that the petitioner had got the said job by concealing the fact that he was involved in a criminal case. He submits that in the present case final report was submitted but the D.I.G. concerned has ordered for further investigation in the matter, hence the petitioner has come up before this Court praying for quashing of the impugned F.I.R.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
