Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Purushottam @ Kallan Dikshit who is involved in Case Crime No. 21 of 2018, under Sections 457, 380, 411 I.P.C., Police Station-Shamshabad, District-Farrukhabad.
It is contended by learned counsel for the applicant that the applicant is not named in the FIR. After four days of the occurrence, applicant was arrested and on the basis of false recovery, he has been named in ten cases including this case also. Prior to this incidence, in six cases applicant has been acquitted and in four cases, he is on bail. Lastly, he submitted that prosecution has not conducted identification parade of the applicant or of the recovered article.
Learned A.G.A., has opposed the prayer for bail.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Purushottam @ Kallan Dikshit, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
