Heard learned counsel for the parties.
The present writ petition has been filed that the petitioner was appointed as Home Guard, however, from the year 2008, the petitioner was not engaged in service.
It is claimed that the petitioner continued to give representation, however, nothing was done. Subsequent to the Government Order came in the year 2016 providing that the persons who had been removed, can be reconsidered, however, as the same was not done, the petitioner approached this Court by filing the Writ Petition No. 4146 of 2021 which was disposed off vide order dated 08.03.2021 directing the consideration of the case in terms of the said Government Order.
In pursuance of the said direction, the impugned order dated 23.3.2021 has been passed rejecting the representation mainly on the ground that even in terms of the Government Order, the dismissal, which had taken place prior to six years, cannot be considered.
In view of the facts, it is clear that after the year 2008, the petitioner except for filing the representation was not at all vigilant in availing the legal remedies.
In view of the fact that more than 13 years have passed since the disengagement of the petitioner in year 2008 and there being no valid explanation for the laches, the writ petition is dismissed on the ground of laches.
The writ petition is dismissed in terms of the said order.
