The petitioner-appellant appeared in the High School Examination of the year 2018. Apart from other subjects, in the subject of Home Science she secured 66 marks and in the subject of Science 71 marks. She filed a writ petition seeking a direction for the revaluation of her marks in the above two subjects. The Court called upon an expert to revaluate the marks of the petitioner-appellant and disposed off the writ petition with the direction to incorporate the marks as awarded by the expert of one of the subject.
The petitioner-appellant has filed this appeal challenging the above order of the Writ Court dated 12.12.2018.
The submission is that according to the instructions on the basis of which the writ petition was disposed off, the marks of the petitioner-appellant would have increased but to the contrary, the respondents are reducing the marks in the above one subject.
Now in order to avoid all controversy, Sri Sanjeev Singh, learned counsel for the petitioner-appellant after some argument submits that he accepts the proposal of the Court that writ petition of the petitioner-appellant be treated as withdrawn making the order passed thereon redundant.
Learned Standing Counsel has no objection if the petition filed by the petitioner-appellant is treated as withdrawn without any change in the marks obtained by the petitioner-appellant in the High School Examination.
In view of the aforesaid facts and circumstances, in the interest of justice, we dispose off this appeal with the direction that the writ petition of the petitioner-appellant (Writ C No. 34379 of 2018 (Purnima Singh Vs. State of U.P. and 4 others)) shall be treated as withdrawn and consequently the order disposing off the same dated 12.12.2018 to be redundant. The marksheet of the High School Examination-2018 issued to the petitioner- appellant earlier shall remain in operation and continue to be valid for all purposes.
The Special Appeal is disposed off with the above observations. A copy of this order be placed on record of the writ petition as well.
