Heard Sri Amit Krishna, learned counsel for the petitioners and Sri Gyan Prakash, learned counsel for the C.B.I. and perused the material brought on record.
The relief sought in this petition is for commanding the respondent no.4 to pass appropriate orders for defreezing Rs.14,40,000/- as requested in reply given by the petitioner on 26.3.2018 in pursuance of the notice issued u/s 91 and 161 Cr.P.C. issued by the respondent no.4 within a stipulated period as stipulated by this Court.
Learned counsel for the petitioners submits that defreezing of the amount of petitioner is creating lot of hurdle in running his business. The petitioner is not guilty of taking any commission as per the allegations of respondent no.4. The respondent no.4 has not given any show cause notice or opportunity of hearing to the petitioners before freezing the amount of the petitioners.
Learned counsel for the C.B.I pointed out that Criminal Misc. Writ Petition No.4533 of 2017 has been filed by Amit Kishore Jain in which this Court has directed the C.B.I to conclude the investigation and submit the progress report of investigation to this Court.
Taking into account the fact that the matter is being investigated by the C.B.I, we are not inclined to interfere in the matter.
The petition lacks merit and is, accordingly, dismissed.
