This Writ Petition is filed for a mandamus to declare the action of respondent Nos.2 to 4 in not initiating any action against respondent Nos.5 to 11 though they have been converting their agricultural lands in Sy.No.377/6 etc., admeasuring Ac.7-00 of Bavipalem village, Nidamarru Mandal, West Godavari District into fish tanks without obtaining permission from the District Level Committee, West Godavari District as per G.O.Ms.No.7 dated 16-3-2013 as illegal and arbitrary.
This Court, by order dated 4-8-2014 while admitting the Writ Petition has granted interim direction to the effect that respondent Nos.5 to 11 shall not carry on digging operations unless they have got their applications registered under the above mentioned G.O.
Mr. T. Durga Prasad, learned Counsel for respondent Nos.5 to 9 and 11, submitted that while his clients do not intend to dig ponds during the pendency of their applications for registration, in the guise of interim order, the writ petitioner is managing to get his application considered for registration earlier than his clients’.
As could be seen from the pleadings of the petitioner, his grievance is that without getting their applications registered, respondent Nos.5 to 9 and 11 have been proceeding with the digging of fish ponds.
In this view of the matter, the Writ Petition is disposed of by restraining respondent Nos.5 to 11 from digging fish ponds till the applications filed by them for registration of their lands for aqua culture are disposed of by the Committee concerned.
As a sequel to the disposal of the Writ Petition, WPMP Nos.27138 and 32626 of 2014 are disposed of as infructuous.
