Shah submitted that the portion of the order dated 8th May 2009, which is not complied, shall be complied by next date of hearing. It was also jointly submitted by learned counsel on both sides that even as the petition has been intermittently heard on earlier several occasions, it is now required to be heard and finally disposed and in case it is not possible to do so, the interim relief has to be vacated. Under the circumstances, it was requested that the matter may be treated as partheard and kept for final disposal SCA/9814/1999 2/2 ORDER on 9th August 2012.
2.0 Therefore, S. O. to 9th August 2012 on condition that if, for any reason, the petition is not heard, the interim relief may be vacated.
2.1 If any further affidavit is filed by the respondent, copy thereof shall be given in advance to learned counsel for the petitioner preferably before 03 days of hearing.
