1. Present application under section 5 of the Limitation Act has been preferred by the applicant herein - petitioner in the main Civil Revision Application, for condonation of delay of 40 days caused in preferring the Civil Revision Application against the order passed by the learned City Civil Court at Ahmedabad in Summary Civil Suit No.2331 of 2011 dtd.21/12/2011
2. Though served, nobody appears on behalf of the respondent. Hence, there is no opposition to the present application.
3. Even otherwise, considering the averments made in the present application in support of the prayer to condone the delay and as sufficient cause has been made out, present application is allowed and the delay caused in preferring the Civil Revision Application is hereby condoned. Rule is made absolute accordingly.
Registry is directed to notify the main Civil Revision Application for admission hearing on 17/7/2012.
