The sole relief pressed for by the learned counsel for the petitioner at the time of hearing of this petition is that the District Magistrate, Muzaffar Nagar should take a decision on the application filed by the petitioner under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.
Learned Standing Counsel appears for respondent Nos. 1 and 2. In view of the order that is proposed to be passed there is no need to issue notices to respondent nos. 3, 4 and 5 as adequate opportunity would be provided by the District Magistrate, Muzaffar Nagar before passing an order.
Learned Standing Counsel states that the District Magistrate, Muzaffar Nagar shall make all endeavours to decide the application expeditiously.
This petition is, accordingly, disposed of with a direction to the District Magistrate, Muzaffar Nagar to decide the application filed by the petitioner after hearing all the parties including private respondent nos. 3, 4 and 5 expeditiously and preferably within a period of two months from the date a certified copy of this order is filed by the petitioner.
It is made clear that the Court has not adjudicated on the merits of the claim of the petitioner and it will be for the the District Magistrate to take a decision in accordance with law.
