JUDGMENT / ORDER

Learned standing counsel Shri N.C. Mehrotra appeared and accepted notice for opposite parties.
Heard learned counsel for the petitioner as well as learned standing counsel.
Learned counsel for the petitioner as well as learned standing counsel submitted that in similar writ petition Misc. Single No.7413 of 2013 (M/s Modern Hide Traders through its proprietor Mohd. Yunus Vs. State of U.P. through Principal Secretary, Agriculture Marketing and Export) this Court has passed order on 11.11.2013, copy of which has been filed alongwith writ petition i.e. paper no.59.
Connect this writ petition alongwith said writ petition Misc. Single No.7413 of 2013 (M/s Modern Hide Traders through its proprietor Mohd. Yunus Vs. State of U.P. through Principal Secretary, Agriculture Marketing and Export).
In view of order dated 11.11.2013 passed by this Court in the said writ petition, learned standing counsel is granted time to seek instructions as to whether the facilities as required under Section 17 of the Act were provided to the petitioner for levying the fee; whether any decision was taken by the Mandi Parishad to levy the fee and whether purchase was made by the petitioner from the society or from the farmer.
List in third week of July, 2014 as fresh for hearing alongwith connected writ petition.
In view of order dated 11.11.2013 passed by this Court in the said writ petition it is directed that till the next date of listing, no coercive method shall be taken against the petitioner.
