1. Learned advocate for the petitioner seeks permission to withdraw the petition since the petitioner intends to make fresh / new application before the Competent Authority for the same purpose.
2. The request to withdraw the petition is granted. The petition stands disposed of a withdrawn.
3. It will be open to the petitioner to make such an application. If such an application is made before the competent authority, the competent authority will consider the said application strictly in accordance with law and in light of the applicable provisions of the Act and Rules. It is also clarified that this order will not be construed, so as to mean that the Court has required the competent authority to accept or allow petitioner's request. The competent authority shall consider the application of the petitioner independently without being influenced by present order or in any manner and strictly in accordance with law after taking into account the relevant and applicable provisions under the Act and Rules. Direct service is permitted.
