Heard Sri Prashant Sharma, learned counsel for the petitioner, learned Standing Counsel for the respondent No.1 and Sri Avneesh Tripathi, learned counsel for the respondent No.2.
At the very outset, Sri Prashant Sharma, learned counsel for the petitioner submits that the petitioner was not permitted to appear in the L.L.B. 1st semester examination conducted in December, 2018 by the respondent-University. Learned counsel for the petitioner further submits that the petitioner was entitled to appear in the aforesaid examination. He further submits that since the aforesaid examinations are over, the petitioner may be permitted to make a representation to the respondent-University to permit him to appear whenever the examinations are held next or special examination may be conducted for the petitioner in view of the wrongful denial of permission to appear in the examination. His only prayer is that such representation may be decided by the respondent-University within a stipulated period of time.
Sri Avneesh Tripathi, learned counsel for the respondent- University does not have any objection to the prayer.
No useful purpose will be served by keeping the petition pending. With consent of parties, the following directions are being issue:-
I. The petitioner shall make a representation highlighting his grievances to the respondent No.2.
II. The respondent No.2 shall decide the aforesaid representation within a period of one month from the date of receipt of a certified copy of this order along with a fresh copy of representation.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has judged the claim of the petitioner on merits. It is for the competent authority to do so with an independent application of mind and in accordance with law.
With the aforesaid direction, the writ petition is finally disposed of.
