Heard Sri Sudhir Dixit, learned counsel for the applicants, Sri Anupam Shyam Dwivedi, who has filed Vakalatnama & counter affidavit on behalf of opposite party no. 2 which are taken on record as well as learned A.G.A. for the State.
This petition under section 482,Cr.P.C. has been filed for quashing the entire proceeding of Criminal Complaint Case No. 25 of 2019, Smt. Yashu Singhal Vs. Puneet Singhal and others, U/s 498-A,323,504,506,354 IPC & 3/4, D.P. Act, pending in the court of Addl. Chief Judicial Magistrate, Hapur, on the basis of compromise arrived at between the applicant no. 1-husband and wife-opposite party no. 2.
Contention of the learned counsel for the applicants is that the aforesaid complaint arises out of matrimonial dispute and the husband and wife-opposite party no. 2 have sorted out their differences and entered into a compromise dated 24.7.2019, a copy of which has been appended as annexure-7 to the affidavit filed in support of the application.
In paragraph no. 10 of the counter affidavit filed on behalf of opposite party no. 2, the compromise has been admitted and it is stated that the opposite party no. 2 has no objection if the present application is allowed and the impugned proceedings are quashed.
In view of the above, the impugned proceedings of Criminal Complaint Case No. 25 of 2019, Smt. Yashu Singhal Vs. Puneet Singhal and others, U/s 498-A,323,504,506,354 IPC & 3/4, D.P. Act, pending in the court of Addl. Chief Judicial Magistrate, Hapur, are quashed.
The application stands allowed.
