THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 1160 of 2014 JUDGMENT: (Per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This appeal has been filed against the interim order passed by the learned Single Judge, whereby His Lordship was pleased to suspend the operation of the temporary appointment of the appellant having found that such an appointment was issued by an incompetent person.
Learned counsel for the appellant, while pressing this appeal, submits that he has no objection if the order of appointment impugned in the writ petition is set aside. However, steps may be taken for making permanent appointment by the appropriate person.
Under these circumstances, we dispose of the appeal by setting aside the order of appointment impugned in the writ petition. Hence, nothing remains in the writ petition. It would be open for the parties to approach the learned Single Judge to get the writ petition disposed of formally. We direct the respondent concerned to take steps forthwith for making appointment of the Sarpanch on regular basis in accordance with law. The entire exercise shall be completed within a period of two months from the date of communication of this order.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
