In a similar facts and circumstances, today this Court in Writ- C No. 2618 of 2019 (Shashi Saxena vs. Greater Noida Industrial Development And Another) has passed the following order:
"The petitioner has filed the present petition challenging the letter dated 24.4.2017 whereby she has been forced to give a proforma affidavit which is contrary to the terms of the allotment led by the petitioner.
The petitioner claims that her husband was allotted plot admeasuring 120 square meters in Sector-36 for residential purpose, however, now the petitioner is being asked to fill a proforma, which is contrary to the terms of allotment.
We have heard learned counsel for the petitioner, learned Standing Counsel for the State-respondent and Sri Alok Singh, learned Advocate, holding brief of Sri Ramendra Pratap Singh, learned counsel appearing for respondent no. 1.
In this regard, on the first instance, we direct the respondent no. 1 to pass a reasoned order hearing the grievances of the petitioner.
The petitioner is permitted to file a comprehensive representation within two weeks from today and the respondent no. 1 is directed to take appropriate decision on the said representation within two months from production of a certified copy of the order, in accordance with law.
It is clarified that we have not expressed our opinion on the merits of the case and it is expected that the respondent no. 1 shall hear and decide the matter independently, in accordance with law. The writ petition is disposed off."
We have heard learned counsel for the petitioner, learned Standing Counsel for the State-respondent and Sri Alok Singh, learned Advocate, holding brief of Sri Ramendra Pratap Singh, learned counsel, appearing for respondent no. 1.
Learned counsel for the parties are agreed that the present matter can be disposed off in terms of the order passed by this Court in the above extracted order.
This writ petition is also disposed off in the same terms.
