Heard learned advocate for the petitioner.

It is not in dispute that the respondent No.3 is allowed to cultivate land bearing Survey No.199 admeasuring around 2.75 vigas of village Elampur and so is admitted in deposition of respondent No.2. That source of earning of the petitioner is almost not more than Rs.1500 p.m.

In the above circumstances, issue Notice returnable on 1st February, 2012.
