Heard learned counsel for the petitioners and the learned Standing Counsel.
This petition seeks the issuance of a direction for the appointment of the petitioners on the post of Ward Aaya and Ward Boy in light of the selection which was held on 7 December 2011 and 23 December 2011.
On an earlier occasion, the petitioners had instituted Writ-A No. 31193 of 2013 assailing an order dated 6 November 2012 in which it was disclosed that appointment orders had not been issued in their favour, since no Doctor had been appointed in the concerned Primary Health Centre. The writ petition was ultimately disposed of with a direction to the respondents to decide the representation of the petitioners. In the meanwhile alleging disobedience of the aforesaid order, contempt proceedings were initiated by the petitioners. The contempt petition was disposed of on 18 April 2018 on the statement of the Additional Chief Standing Counsel who apprised the Court that since the recruitment process initiated in 2011 could not be completed, it was cancelled.
From an overall conspectus of the aforesaid facts, it is evident that the claim of the petitioners would not merit any further consideration since the selection process has already been cancelled. The Court further takes note of the fact that the mere empanelment or selection of the petitioners in 2011 would not invest in them any indefeasible right to seek appointment.
The writ petition is consequently dismissed.
