ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for respondents. 1 and 2.
The petitioner is a Software Engineer working in USA. After completion of his studies in the year 2000, he went to USA seeking employment and after securing a job in New Generation Consultants company, he had been working there. He married the fourth respondent in the year 2001 and his wife was granted H4 VISA in the month of September, 2001. They lead happy matrimonial life for a period of three years. The fourth respondent also secured green card. Thereafter some misunderstandings arose in between them and thereby the fourth respondent deserted the petitioner and started living separately with her sister in St . Louis city, Missouri State. While so, in the month of June, 2006, the fourth respondent returned to India and at the instance of her parents, she made a complaint to the II Town Police Station, Karimngar on 10.07.2006 against the petitioner and his family members. Based on the same, the police registered a case in Cr.No. 202 of 2006 under Sections 498-A and 506 IPC read with Sections 3 and 4 of Dowry Prohibition Act. Subsequently the said crime was transferred to Women Police Station for the purpose of investigation. The said crime taken on file in C.C.No. 520 of 2008 and ultimately it was ended in acquittal of the petitioner. During the pendency of the said case, the first respondent addressed a letter dated 8.4.2008 to the second respondent to issue Look out circular (LOC) against the petitioner and accordingly the second respondent issued LOC. In view of the same, all the Air Ports in India were alerted. Challenging the same, the present Writ Petition was filed.
Having regard to the subsequent developments in the matter with regard to acquittal of the petitioner in C.C.No.520 of 2008 by the learned Additional Judicial First class Magistrate, Karimangar through order dated 29.08.2011, the first respondent is directed to reconsider the case and issue necessary orders to the second respondent to withdraw Look Out circular if not warranted. The first respondent shall take necessary action in regard thereto within three months from the date of receipt of a copy of this order.
The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
