ORDER:
Heard.
2. Petitioners submit that they were given a notice bearing No./B/6800/2013 dated 22.10.2013 alleging violation of Section 3 of the A.P. Assigned Lands (Prohibition of Transfers) Act and that they had already filed a reply dated 29.10.2013. However, no orders are passed so far. Meanwhile, petitioners claim that in similar circumstances, the Revenue Divisional Officer considered similar allegations with regard to one Smt. Penta Narsamma in Sy.No.1324 admeasuring Ac.0.23 guntas and upheld her case. Petitioners state that the said order dated 25.03.2006 clearly covers their case also. However, the Tahsildar has not passed any order as yet and on the contrary, there is a possibility of dispossession of petitioners without passing any order. Petitioners also state that they have filed a further representation dated 24.09.2014 seeking opportunity of personal hearing.
3. Since the Tahsildar has not taken any coercive steps after giving notice to the petitioners, referred to above, there is no reason to accept the contentions of the petitioners that they are likely to be dispossessed without passing any orders. Respondent No.4 is directed to consider the explanation of the petitioners to the show cause notice including representation dated 24.09.2014 said to have been filed by the petitioners before him and then take appropriate decision, in the matter, in accordance with law.
The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
