Heard Sri Akhilesh Singh, learned counsel for the appellant and Sri Gyan Singh, learned counsel appearing for the CBI.
The first bail application of the appellant Pujari was rejected by this Court on 17.7.2018 and this is the second bail application.
The only ground of the learned counsel for the applicant is that the applicant is languishing in jail since 15.32017 and the trial has not been concluded. The trial has already been expedited by this Court Learned counsel for the CBI opposed the prayer for bail and submitted that the first bail application of the appellant was rejected on merit.
In view of the above, without expressing any opinion on the merits of the case and considering the fact that the contraband article which has been recovered from the possession of the applicant is much above from the commercial quantity and there is no explanation given by the applicant of his false implication in the present case, we find no good ground for grant of bail to the appellant Pujari convicted and sentenced in RC 220 2017 E0003, CBI, EOU-V, EO- II, New Delhi under sections 8/20/29 of Narcotic Drugs and Psychotropic Substances Act, 1985, P.S. CBI, EOU-V, EO-II, New Delhi, District Saharanpur.
Accordingly, the second bail application is rejected.
The trial court is directed to expedite the trial and conclude the same within eight months from the date of submission of a certified copy of this order.
