Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition seeks a direction upon the respondents 1 and 2 to carry out fair investigation of Case Crime No. 0318 of 2017 lodged at P.S. Gajraula, District Jyotiba Phule Nagar/Amroha, It appears that for the same prayer, the petitioner had earlier filed Crl. Misc. Writ Petition No. 21625 of 2018 which was disposed off by order dated 09.08.2018.
In view of the above, this is a second petition for the same cause of action and therefore the same is not maintainable. In case, the order passed by this Court dated 09.08.2018 in Writ Petition No. 21625 of 2018 has not been complied with, the petitioner is at liberty to take recourse to contempt proceeding.
