Heard learned counsel for petitioner and perused the record.
The present petition has been filed by petitioner seeking direction to court below to decide the Case No.843 of 2018 (Smt. Puja Pandey Vs. Brijesh Tiwari) under Section 13 of Hindu Marriage Act, P.S. Jahanganj, District Azamgarh pending in the court of Additional Principal Judge, Family Court, Court No.5, Azamgarh within a stipulated period.
It is submitted by learned counsel for petitioner that petitioner had filed suit for divorce under Section 13 of Hindu Marriage Act on 11.9.2013. It is further submitted that opposite parties had already put in appearance on 13.3.2019 but on account of delaying tactics adopted by respondent-defendant the case could not be proceeded and is pending since 2018.
Considering the facts and circumstances of the case and without commenting on the merits of the case, learned Additional Principal Judge, Family Court, Court No.5, Azamgarh is directed to decide Case No.843 of 2018 (Smt. Puja Pandey Vs. Brijesh Tiwari) under Section 13 of Hindu Marriage Act, P.S. Jahanganj, District Azamgarh, preferably within a period of one year from the date of production of certified copy of this order, unless there is any legal impediment.
With the aforesaid directions, the petition is disposed of.
